India has taken a significant step towards global environmental leadership by approving its participation in the Biodiversity Beyond National Jurisdiction (BBNJ) Agreement. This decision, sanctioned by the Union Cabinet under the guidance of Prime Minister Narendra Modi, underscores India’s commitment to the conservation and sustainable use of marine biodiversity in international waters, often referred to as the ‘High Seas’.
The BBNJ Agreement, formulated under the framework of the United Nations Convention on the Law of the Sea (UNCLOS), aims to address the critical gaps in governance and protection of marine biological diversity beyond national jurisdictions. These expansive oceanic areas are vital for maintaining global ecological balance and are open to all nations for navigation, submarine cable-laying, and other lawful activities.
Dr Jitendra Singh, Minister of State (Independent Charge) for the Ministry of Earth Sciences and Ministry of Science and Technology, expressed India’s proactive approach towards environmental conservation. He affirmed that India will proceed with signing and subsequent ratification of the BBNJ Agreement through legislative processes, demonstrating India’s commitment to upholding global environmental standards and fostering international cooperation.
The BBNJ Agreement introduces mechanisms for the sustainable management of marine resources, emphasizing ecosystem-based approaches, the precautionary principle, and equitable benefit-sharing. It sets a precedent for transparent governance in utilizing marine biological diversity while promoting the integration of traditional knowledge and cutting-edge scientific research.
India’s endorsement of the BBNJ Agreement is expected to yield substantial benefits, including enhanced opportunities for scientific collaboration, technology transfer, and capacity building in marine sciences. Dr M Ravichandran, Secretary of the Ministry of Earth Sciences (MoES), highlighted that India’s participation will strengthen its strategic position in international waters, facilitating advanced research initiatives and bolstering efforts to conserve marine ecosystems.
Once in effect, the BBNJ Agreement will complement existing UNCLOS implementation agreements, which regulate activities such as deep-sea mining and fisheries management. UNCLOS, established in 1982 and ratified by a vast majority of nations, provides a comprehensive legal framework for ocean governance, ensuring fairness, equity, and sustainability in maritime activities.
India’s proactive stance on the BBNJ Agreement underscores its commitment to achieving global Sustainable Development Goals, particularly SDG14 (Life Below Water), and reinforces its role as a responsible global leader in environmental stewardship. By embracing progressive environmental policies and promoting international collaboration, India aims to safeguard marine biodiversity and ensure the health and resilience of our oceans for future generations.
